1. Introduction

Welcome to the Unburden AI platform ("Platform," "Services"). These Terms and Conditions ("Terms") govern your access to and use of the Services provided by Consuly Pte. Ltd. ("Consuly," "we," "our," "us"), a company registered in Singapore which owns and operates the Platform under the brand name "Unburden AI".

By accessing or using our website, mobile application, or any of our Services, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you ("User," "you," "your") and Consuly Pte. Ltd.

If you do not agree with these Terms, please do not access or use our Services. By using our Services, you represent that you are at least 18 years of age or the legal age of majority in your jurisdiction.

2. Definitions

In these Terms, the following definitions apply:

• "Account": Refers to the user account you create to access and use our Services.
• "AI Personas": Refers to the artificial intelligence-powered content creators that are trained based on your website's content and style, or other information you provide.
• "Content": Refers to any text, images, or other materials generated by our AI Personas through the Services or submitted by you.
• "Free Trial": Refers to the initial limited-use trial offered to new users, subject to the terms specified at the time of sign-up (e.g., 10 free posts).
• "Subscription": Refers to the paid plans that provide access to our Services beyond any Free Trial or basic usage limits.
• "Platform" / "Services": Refers collectively to the Unburden AI website, mobile application, AI content generation tools, and related services provided by Consuly Pte. Ltd.

3. Account Registration

To use our Services, you must create an Account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.

We reserve the right to suspend or terminate your Account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading, or if you fail to comply with these Terms.

4. Service Description

Unburden AI provides an AI-powered content creation platform designed to generate blog posts and other content using AI personas, potentially trained on your website's style and voice or other inputs. Our Services may include:

• AI Persona Generation: Analysis of provided information (like website URLs or text samples) to create custom AI personas.
• Content Creation: Generation of text-based content using these AI personas.
• Potential SEO Enhancement Features: Tools or suggestions aimed at improving search engine visibility.
• Multi-Platform Publishing Integrations: Features allowing distribution of content across various platforms connected to your account.

The specific features available to you depend on your Subscription plan. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice, although we will endeavor to provide notice of significant changes.

5. Subscription Plans and Payments

We offer various Subscription plans with different features and pricing. The details of each plan are available on our pricing page. By subscribing to a paid plan, you agree to pay all fees associated with your selected plan.

5.1 Free Trial

New users may be eligible for a Free Trial (e.g., 10 free posts). Once the limits of the Free Trial are reached, you will need to subscribe to a paid plan to continue generating content beyond the free allowance.

5.2 Billing

For paid Subscriptions, Consuly Pte. Ltd. will bill you in advance on a recurring basis (e.g., monthly or annually, depending on your chosen billing cycle). You authorize us (Consuly Pte. Ltd.) to charge your designated payment method for all applicable fees associated with your Subscription. All payments are due in the currency indicated on the pricing page or invoice.

5.3 Refunds

For monthly subscriptions, we generally do not provide refunds or credits for partial months of service or unused periods. For annual subscriptions, we may offer a limited money-back guarantee as specified on our pricing page or offer at the time of purchase (e.g., a 30-day money-back guarantee). If you are eligible and request a refund within the specified period, we will process it according to our policy. Refund eligibility and process details will be clearly stated.

5.4 Changes to Pricing

We reserve the right to change our Subscription fees at any time. If we change the fees for your existing Subscription, we will provide notice of the change on our website or by email at least 30 days before the change takes effect. Your continued use of the Services after the price change constitutes your agreement to pay the modified amount.

6. Content Generation, Ownership, and Responsibility

6.1 Content Ownership

Subject to your compliance with these Terms, you retain ownership of the specific Content generated by our AI Personas for your Account after it has been generated and delivered to you. You have the right to use, modify, distribute, and publish this generated Content as you see fit, subject to the responsibilities outlined in Section 6.3.

6.2 Input Analysis (e.g., Website Analysis)

To create AI Personas or generate relevant content, the Services may analyze inputs you provide, such as website URLs or text samples. By providing such inputs, you represent and warrant that you have the necessary rights or permissions to allow us to process this information for the purpose of providing the Services. We primarily use this input to understand style, tone, and subject matter to train or prompt the AI; we do not claim ownership over your original input materials.

6.3 Content Accuracy and User Responsibility

Our Services utilize sophisticated artificial intelligence technologies, including large language models (LLMs), to generate Content. While we strive to generate high-quality and relevant content, you explicitly acknowledge and agree that:

• AI Limitations: AI-generated content, by its nature, may contain errors, inaccuracies, omissions, inconsistencies, or biased information. LLMs are known to sometimes produce "hallucinations" or make false claims that may appear plausible but are factually incorrect. The Content may also not be completely up-to-date or reflect recent events accurately.
• No Guarantees: Consuly Pte. Ltd. makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, legality, or timeliness of the Content generated by the Services. We do not guarantee that the Content will be entirely free from factual errors, plagiarism, copyright issues, or that it will meet your specific requirements or comply with all applicable laws, regulations, or ethical standards in your industry or jurisdiction. The Content is provided "AS IS" and "AS AVAILABLE".
• Mandatory User Review and Sole Responsibility: You are solely and exclusively responsible for carefully reviewing, editing, fact-checking, and verifying all Content generated through the Services before you publish, distribute, or otherwise use it in any way. This includes ensuring the Content is accurate, appropriate for your intended audience, compliant with applicable laws (including advertising standards, disclosure requirements, etc.) and platform policies, and does not infringe on any third-party rights (including copyright, trademark, privacy, or publicity rights).
• Assumption of Risk: You assume all risks associated with the use, publication, and distribution of the Content generated via our Services. Reliance on any information within the Content is solely at your own risk. Consuly Pte. Ltd. expressly disclaims any liability or responsibility for any Content published or used by you.

7. User Responsibilities and Acceptable Use

When using our Services, you agree not to:

• Use our Services to generate Content that is illegal, harmful, fraudulent, deceptive, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Use our Services to generate Content that infringes upon any patent, trademark, trade secret, copyright, right of publicity, or other proprietary rights of any party.
• Use our Services to generate misinformation, disinformation, or content that promotes illegal activities, hate speech, discrimination, harassment, or violence.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Services, except to the extent permitted by applicable law.
• Use any automated system, including "robots," "spiders," or "offline readers," to access the Services in a manner that sends more request messages to our servers than a human can reasonably produce in the same period using a conventional web browser (except for public search engines indexing).
• Interfere with or disrupt the integrity or performance of the Services or servers or networks connected to the Services.
• Use the Services for any purpose that competes directly with the Services offered by Consuly Pte. Ltd. / Unburden AI.

We reserve the right to monitor your use of our Services to ensure compliance with these Terms. If we determine, in our sole discretion, that you have violated these Terms, we may suspend or terminate your Account and access to the Services without prior notice.

8. Privacy and Data Usage

Our Privacy Policy, which is available on our website and incorporated into these Terms by reference, explains how we collect, use, share, and protect your personal information and other data. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

We may use anonymized and aggregated data derived from your use of our Services (which does not identify you personally) to improve our algorithms, develop new features, and enhance the overall Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSULY PTE. LTD., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR OBTAINED THROUGH THE SERVICES;
• ANY CONTENT GENERATED BY OR OBTAINED FROM THE SERVICES, INCLUDING BUT NOT LIMITED TO ANY INACCURACIES, ERRORS, OMISSIONS, FALSEHOODS, HALLUCINATIONS, OR OUTDATED INFORMATION CONTAINED THEREIN;
• YOUR PUBLICATION OR USE OF ANY CONTENT GENERATED BY THE SERVICES, PARTICULARLY IF USED WITHOUT ADEQUATE INDEPENDENT REVIEW, VERIFICATION, AND EDITING AS REQUIRED BY THESE TERMS;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS, ACCOUNT, OR CONTENT; OR
• ANY OTHER MATTER RELATING TO THE SERVICES.

IN NO EVENT SHALL CONSULY PTE. LTD.'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO CONSULY PTE. LTD. FOR THE SERVICES DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND EVEN IF CONSULY PTE. LTD. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Termination

You may terminate your Account and stop using the Services at any time by contacting us or using any account deletion option provided within the Platform settings. Upon termination, your right to use the Services will immediately cease.

We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions (Section 6.1, subject to responsibilities in 6.3), warranty disclaimers (especially in Section 6.3), indemnity provisions (if any were added), limitations of liability (Section 9), and governing law provisions (Section 12).

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, which may be provided via email to the address associated with your Account or by posting a notice on our website/Platform. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must stop using the Services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Singapore.
